3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
SLC has a responsibility to provide customer satisfaction measurement to an agreed baseline and to report this to government and it's Board as a condition of funding arrangements. Due to delays which were not foreseeable by SLC there has been a period during which SLC has been unable to fulfil it's mandatory obligations to UK government in providing these measurements. In order to provide the information to the required baseline in the time period required for government, there is no opportunity to approach the market, or undertake significant implementation. The technical expertise to support SLC is only available via the previous supplier within the timescales required. The contract shall be for the period of one year which is the minimum viable timescales.
